Do you qualify for Italian Citizenship by Descent?

Could You Be an Italian Citizen Without Even Knowing It? 🇮🇹

Have you ever daydreamed about sipping espresso in a sun-soaked piazza, strolling through historic cobblestone streets, or calling Italy your home? Well, what if I told you that if you have Italian ancestors, you might already be entitled to Italian citizenship?

Yep, that’s right. No visa struggles, no residency requirements—just pure Italian heritage unlocking a world of opportunities. But before you pack your bags for Rome, let’s find out if you actually qualify.

What is Italian Citizenship by Descent? (And Why It’s So Easy!)

Italy follows the principle of Jure Sanguinis (the Latin way of saying “Right of Blood”). In simple terms, if your bloodline traces back to an Italian citizen, you could be eligible for an Italian passport—even if you were born elsewhere!

What does this mean for you?
Freedom to live, work, and study anywhere in the EU—no visas required!
A second passport (dual citizenship is allowed in most cases).
Access to healthcare & social benefits in Italy.
An official claim to your Italian heritage (because, let’s be honest, that’s pretty cool).

Sounds amazing, right? So, how do you know if you qualify?

Step 1: Check Your Italian Lineage 👀

To be eligible, your Italian ancestor must:
✔️ Have been born in Italy after March 17, 1861 (the unification of Italy).
✔️ Not have renounced their Italian citizenship before passing it down to the next generation.
✔️ If they became a citizen of another country, it must have been after July 1, 1912 (or the line is broken).

If these conditions check out, you’re on the right track! ✅

Step 2: The 1948 Rule – Does It Affect You?

Here’s where it gets a bit tricky. If your lineage passes through a female ancestor and her child was born before January 1, 1948, the process isn’t as straightforward. But don’t worry! You can still apply for citizenship (albeit not through DolceVisa®) —it just means you’ll need to go through a court case in Italy instead of the consulate. We recommend getting in touch with a law firm for this.

Thousands of people have successfully obtained their citizenship this way, so it’s totally doable!

Step 3: Did Anyone in Your Family Renounce Italian Citizenship?

If someone in your direct bloodline formally renounced their Italian citizenship before an Italian authority, it could impact your eligibility. But don’t panic yet! It depends on when and how it happened. If this happened, we recommend speaking to us first! You can do this by booking a call with us!

And here’s a big update…

🚨 New Rule (November 2024) – Important Change! 🚨

A new Italian law clarified that if your Italian ancestor became a foreign citizen before August 16, 1992, while their child (your direct ancestor) was still a minor, then the line of citizenship was broken—unless the ancestor later reclaimed it (before they became a legal adult).

This rule has disqualified many applicants—so if this applies to you, you might need to explore other options. Again, if you're unsure about this, book a call with us!

Step 4: Gather Your Paperwork (Yes, There’s a Bit of It) 📄

If you meet the eligibility criteria, you’ll need to collect:
✔️ Your ancestor’s Italian birth certificate from their hometown (Comune).
✔️ Marriage, death, and naturalization records of your Italian ancestor.
✔️ Your full birth certificate (and those of your direct ancestors).
✔️ Translations & apostilles for documents not in Italian.

Sounds overwhelming? That’s where DolceVisa® comes in!

So, How Do You Actually Apply?

You’ve got three options, depending on your situation:

🏛️ 1. Apply Through the Italian Consulate (Slow, but Free)

  • If you live outside Italy, you’ll apply at your local Italian consulate.

  • Some consulates have wait times of several years due to high demand.

✈️ 2. Apply in Italy (Faster, but Requires Residency)

  • If you move to Italy and establish residency, you can apply directly at your local Comune.

  • This is often quicker but requires living in Italy during the process.

⚖️ 3. Judicial Route (For 1948 Cases & Special Circumstances)

  • If your case involves the 1948 Rule, you’ll need to file a legal case in Italy.

  • This requires a lawyer, but many applicants win their cases and get their citizenship!
